CLAIM 459352 Employee Dishonesty

 

Resubmitted to replace the lost original clam submitted May 13, 2006 and misplaced after receipt by XXXXXXXXXX Insurance Company.

 

Dunardry Heritage Association (DHA), also known as Clan MacTavish or Clan MacTavish/Thompson Worldwide is a tax-exempt organization under 501(c)(3) and classified as a public charity under 509(a)(2) of the Internal Revenue Code.

 

Section I Policy acquisition and coverage questions.

Ø Policy issued effective November 9,2005 Payment sent November 16,05. (atch 1)

Ø The Binder (expires August 14, 2005) was reviewed by the DHA Board of Directors. "Liability is for injury to non-participates" "Crime applies to employees, but it is a blanket coverage for non-profit organizations including all individuals working as uncompensated volunteers." (atch 2)

Ø Change of address during the phone conversation with XXXXXXXXX XXXXXXX of XXXXX Insurance Agency. She told us verballythere was a memo in the file stating that Donley Tomey had integrity and good character as noted by personal association with the Agency Broker. (atch 3)

Section II History of Employee and Dishonesty.

Donley Tomey, 202 Huntington Woods, Waynesburg PA 15370; assumed duties as membership Secretary of Dunardry Heritage Association (DHA) from Patricia Adams on January 23,2003. He was named Director, reaffirmed as membership Secretary and appointed Secondary Financial officer for Dunardry Heritage Association on or about July 5, 2005.

 

NARRATIVE OF EVENTS: On or about January 2006, DHA was targeted for a hostile takeover by Steven MacTavish (AKA Chief), 1447 Pembroke Dr., Oakville, ON Canada L6H 1V6 in collusion with Donley Tomey (DHA Membership Secretary and secondary financial officer) and Tom Thompson, (DHA Webmaster), 6505 Hastings Dr. Colorado Springs, CO 80919. Their manifest intent was to cause substantial financial loss to DHA, obtain financial benefit via access to the DHA database of members and contributors and eliminate the DHA as a viable organization.
